Delve Terms of Service
Effective date: September 5, 2026
These Terms of Service ("Terms") are a legal agreement between you and Nolan Joseph Connolly ("Delve," "we," "us," or "our"). They govern your access to and use of the Delve iOS application and related services (together, the "Service"). By downloading, installing, or using Delve, you agree to these Terms. If you do not agree, do not use the Service.
If you downloaded Delve from the Apple App Store, this agreement is between you and Nolan Joseph Connolly only, and not with Apple Inc. ("Apple"). See the "Apple App Store Terms" section below for provisions required by Apple.
1. Acceptance and Eligibility
You must be at least 13 years old to use Delve. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using Delve on behalf of a minor for whom you are a parent or legal guardian, you accept these Terms on that minor's behalf and are responsible for their use of the Service. Delve is intended for one individual person per account. You may not create or use an account on behalf of another person or share your account with others. You also represent that you are not located in, and are not a national or resident of, any country subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.
2. The Service
Delve delivers short, interactive educational lessons in a personalized feed, along with a per-lesson chat assistant you can use to ask follow-up questions. Pieces and chat responses are generated using artificial intelligence and are drawn from and grounded in Wikipedia content, as described in Section 7.
2.1 Free tier
Without a paid subscription, you can play up to 2 lessons per day from the shared library.
2.2 Subscriptions
A paid subscription unlocks unlimited lessons, the "Ask" assistant for follow-up questions, the ability to prove what you have learned on the Learnings page, and new lessons generated for you from your interests, plus any other features we designate as subscriber features from time to time. Subscription billing terms are in Section 3.
We may change, add to, or remove features of the Service, including the number of free or subscriber lessons available per day, at any time. We will provide reasonable notice of material changes where practical.
3. Subscriptions and Billing
3.1 Apple In-App Purchase
All Delve subscriptions are sold and billed through Apple's In-App Purchase system. Delve does not process, store, or have access to your payment card details. Available plans currently include:
- Monthly: $14.99/month (or the equivalent price in your local currency and App Store region).
- Annual: $119.99/year, billed as a single yearly charge (equivalent to $9.99/month, or the equivalent price in your local currency and App Store region).
Prices are set in each App Store region and may differ from the U.S. dollar amounts above. The price shown to you at checkout in the App Store is the price that applies.
3.2 Auto-renewal
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your Apple Account will be charged for renewal within 24 hours before the end of the current period, at the price you most recently agreed to, unless you cancel before that time.
3.3 Managing and cancelling your subscription
You can review, manage, and cancel your subscription at any time in your device's Settings app, under Settings > [your name] > Subscriptions. Cancelling stops future renewals but does not refund any portion of a period already paid for, and you will keep subscriber access through the end of the current billing period.
3.4 Refunds
Delve does not process refunds directly. All purchases are billed by Apple, and refund requests are handled by Apple under its own policies. To request a refund, visit reportaproblem.apple.com or use the "Report a Problem" feature in the App Store.
3.5 Price changes
We may change subscription prices from time to time. If we increase the price of your plan, we will provide advance notice as required by the App Store, and the new price will apply starting with your next renewal after the change takes effect, unless you cancel before then.
4. Accounts and Security
You can create a Delve account using Sign in with Apple or email one-time-passcode (OTP) sign-in. You are responsible for maintaining the confidentiality of your Apple Account credentials and any device or email access used to sign in to Delve, and for all activity that occurs under your account. Notify us promptly at support@delvelearning.app if you suspect unauthorized use of your account. You may delete your account at any time from within the app; see Section 12 for what account deletion does.
5. Acceptable Use
When using Delve, you agree not to:
- Scrape, crawl, harvest, or otherwise systematically extract data, lessons, or other content from the Service by automated means.
- Abuse, overload, or attempt to manipulate the per-lesson chat assistant, including by attempting to extract system prompts or internal instructions, generate content unrelated to the lesson it is attached to, or use it to generate content that violates these Terms.
- Circumvent, disable, or attempt to bypass daily lesson limits, subscription checks, or other technical restrictions in the Service.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the proprietary parts of the Service, except to the extent such restriction is prohibited by applicable law.
- Use the Service to violate any applicable law, infringe any third party's rights, or transmit malicious code.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity, in your account, interest inputs, or chat messages.
- Use the Service in any way that could disable, overburden, damage, or impair it, or interfere with any other party's use of it.
We may investigate and take appropriate action against anyone who violates this section, including suspending or terminating accounts, as described in Section 13.
6. Delve's Intellectual Property
Delve's software, application design, user interface, feature set, curation logic, branding, and all other elements of the Service that are original to Delve (collectively, "Delve IP") are owned by Nolan Joseph Connolly and are protected by intellectual property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Delve app on Apple-branded devices you own or control, solely as permitted by the App Store's Usage Rules, and solely for your personal, non-commercial use. Nothing in these Terms transfers ownership of any Delve IP to you. All rights not expressly granted are reserved.
7. Wikipedia-Derived Content and Licensing
Delve's educational lessons are generated from, and reference, content sourced from Wikipedia.
7.1 Text
Wikipedia article text is licensed under the Creative Commons Attribution-ShareAlike 4.0 International License (CC BY-SA 4.0). Where a Delve lesson incorporates or is substantially derived from Wikipedia text, that underlying content remains subject to CC BY-SA 4.0, and your rights to reuse that underlying material (for example, the right to copy, redistribute, and adapt it, with attribution and under the same license) come from the CC BY-SA 4.0 license itself, not from Delve. Delve's original presentation of that content within the app, including its structure, interactive elements, and any Delve-authored framing, explanation, or commentary, is Delve IP as described in Section 6, and is licensed to you only under Section 6, not under CC BY-SA 4.0.
7.2 Images
Images shown in Delve carry their own individual licenses, which vary by image, and Delve displays the applicable credit and license information for each image in-app. Your use of any image is subject to that image's specific license, not to a blanket license from Delve.
7.3 No warranty of completeness
Wikipedia content changes over time and Delve's lessons reflect Wikipedia content as of when they were generated. We do not guarantee that a lesson reflects the current state of its source Wikipedia article.
8. Your Inputs and License to Delve
When you use Delve, you provide certain inputs, including your selected interests, an optional free-text description of your interests, and messages you send to the per-lesson chat assistant ("User Inputs").
You grant Delve a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, and process your User Inputs to operate, provide, and improve the Service, including to generate new educational lessons. Pieces generated based on a subscriber's interests may be added to Delve's shared content library and made available to other users. When we do this, we strip the lesson of any personal information; a lesson added to the shared library does not identify you or reveal your specific inputs to other users.
You represent that you have the right to submit your User Inputs and that they do not violate any third party's rights or applicable law.
9. AI-Generated Content and No Professional Advice
Delve's lessons and chat assistant responses are generated using artificial intelligence, including, for the chat assistant, the ability to search the web for information.
Delve is provided for general educational and informational purposes only. AI-generated content may be incomplete, outdated, or contain factual errors, and you should not treat any lesson or chat response as a guaranteed accurate or complete source of information. Nothing in the Service constitutes medical, legal, financial, or other professional advice, and no lesson or chat response should be relied upon as a substitute for consulting a qualified professional. You are responsible for independently verifying any information from Delve before relying on it, particularly for decisions with health, legal, financial, or safety consequences.
10. Reports and Corrections
If you believe a lesson contains an error, is offensive, or otherwise should be reviewed, you can report it in-app. When we determine a correction is warranted, we generally address it by superseding the lesson with a corrected version rather than editing it in place. We review reports at our discretion and do not guarantee a particular outcome, timeline, or response to any individual report.
11. The Wikimedia Pledge
Delve has publicly stated its intention to donate 50% of its profits to the Wikimedia Foundation. This pledge reflects a voluntary business commitment by Nolan Joseph Connolly. The public wording of the pledge is: "We donate 50% of our profits to the Wikimedia Foundation." It is not a term of the agreement between you and Delve, is not a condition of any purchase or subscription, does not create any contractual right for you or any third party to enforce it, and does not modify the price or nature of anything you purchase from Delve. No portion of any payment you make to Delve is a charitable contribution or donation, and no payment to Delve is deductible as a charitable contribution for tax purposes.
12. Termination
You may stop using the Service and delete your account at any time using the account deletion option in the app. Deleting your account ends your access to your saved history and account data as described in our Privacy Policy, and, if you have an active subscription, does not by itself cancel that subscription; you must separately cancel your subscription through your Apple Account settings as described in Section 3.3 to stop future billing.
We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms, misused the Service, or for any other reason at our discretion, including discontinuing the Service generally. Sections of these Terms that by their nature should survive termination (including Sections 6, 7, 9, 11, 15, 16, 17, and 18) will survive.
13. Disclaimers of Warranty
THE SERVICE, INCLUDING ALL PIECES, CHAT RESPONSES, AND OTHER CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DELVE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOLAN JOSEPH CONNOLLY AND HIS AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOLAN JOSEPH CONNOLLY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100 USD) OR (B) THE AMOUNTS YOU PAID TO DELVE THROUGH THE APP STORE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify and hold Nolan Joseph Connolly harmless from any third-party claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service. We will provide you with notice of any such claim and, where reasonably possible, an opportunity to participate in its defense.
16. Apple App Store Terms
The following provisions apply because Delve is distributed through the Apple App Store, and are required by Apple's licensing rules for apps of this kind. In the event of any conflict between this Section 16 and any other part of these Terms regarding the matters below, this Section 16 controls.
- This agreement is between you and Nolan Joseph Connolly only, not with Apple, and Apple is not responsible for the Service or its content.
- The license granted to you to use the app is limited to a non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by the App Store's Usage Rules.
- Delve, not Apple, is solely responsible for providing any maintenance and support services for the Service, as described in these Terms (or as required under applicable law). Apple has no obligation whatsoever to furnish any maintenance or support services for the Service.
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Delve, as set out in these Terms.
- Delve, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Delve, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim, to the extent required by these Terms.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties, as also stated in Section 1.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the app or by other reasonable means before the changes take effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service and may delete your account as described in Section 12.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles, except where applicable law requires otherwise based on your location. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small claims court where that court has jurisdiction. To the extent permitted by law, you and Delve each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class or representative action. Nothing in this section limits any non-waivable consumer protection rights you have under the law of your country of residence.
19. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nolan Joseph Connolly regarding the Service.
